  • Patrick was part of the plaintiffs’ trial team in the American Trucking Associations v. State of Idaho litigation brought on behalf of truckers where a $27 million settlement was reached for the plaintiff-class after a successful trial of the liability phase of the case.
  • A $7.2 million settlement of a cerebral palsy case brought under the Federal Tort Claims Act. The baby suffered anoxic brain injury at birth. A portion of the funds is invested in trust with lifetime benefits for the child of $19 million.
  • $5 million settlement on a birth injury cerebral palsy case.
  • $1.25 million in settlement for our clients against the Bayer pharmaceutical corporation in the Florida.
  • An $800,000 jury verdict in a case tried in Boise, Idaho on behalf of a construction worker client who was seriously burned by an exploding propane heater.
  • $1 million in a case of medical negligence against an orthopedic surgeon.
  • $2.5 million in a case of pediatric anoxic brain injury due to medical malpractice.
  • $2 million in a birth injury case involving permanent brain injury.
  • $1.2 million in a case involving a hospital acquired infection.
  • $3 million in a birth asphyxia-cerebral palsy medical malpractice case. A portion of the settlement is invested in trust for the benefit of the child and is projected to pay $10 million in lifetime benefits.
  • $1.6 million for severe injuries at a forest service campground.
  • $800,000 settlement for our client against a Veterans Administration Hospital for failure to timely diagnose a spinal cord injury by failing to order an MRI and neurosurgery consult.

  • $825,000 for our elderly veteran client who suffered a leg amputation following knee replacement surgery. This case was brought against the VA under the FTCA.
  • $500,000 in a shoulder-dystocia brachial-plexus birth injury case.
  • A significant confidential settlement against the national manufacturer of a residential natural gas water heater. Our client, the plaintiff, alleged that the water heater was defectively designed and that it caused a flammable vapor explosion which, in turn, caused a major residential fire resulting in third degree burns over nearly all of our client’s lower body.
  • A complete defense jury verdict in favor of Patrick’s truck driver client accused of negligently allowing a wheel to become detached from his tractor-trailer rig, in which the co-defendant wheel installer suffered a $900,000 verdict by the plaintiff.
  • Our client was one of five family members to share in a $6 million jury verdict in a medical negligence case against a Boise hospital, two anesthesiologists, and a transfusion technician. The case involved a botched blood transfusion process resulting in the death of our client’s 28-year-old daughter as part of a routine back surgery. The transfusion company appealed and the Idaho Supreme Court upheld the verdict in the winter of 2009.
  • A significant confidential settlement on behalf of a young family in a shoulder dystocia case involving obstetrical medical malpractice causing a traumatic, permanent birth injury to the child’s brachial plexus nerves.
  • A major confidential settlement on behalf of a young girl with a permanent Erb’s Palsy birth injury.
  • A large confidential settlement for our client in a case of medical malpractice against a hospital wherein a surgical instrument caused a significant burn to the patient’s abdominal region resulting in a long-term healing process and permanent scarring.
  • A large confidential settlement for our client in a case of medical malpractice involving serious neurological injuries, resulting hospitalization, long term medicine regimen, and lasting psychological injuries.
  • A $500,000 insurance policy limits settlement against the at-fault party in an ATV four-wheeler rollover case.
  • A large confidential settlement on behalf of our client in a case filed under Idaho’s Whistle Blower Act (Idaho Protection of Public Employees Act) against Boise State University (BSU). In the lawsuit, our client alleged that she was terminated for reporting falsification of federally required I-9 employment verification documentation for certain new hires at BSU.
  • A confidential settlement on behalf of our client who suffered the traumatic partial amputation of three toes on his right foot, including the great toe, when he was struck broadside in a parking lot by a negligent driver of an SUV while on his motorcycle. The settlement included compensation for permanent nerve damage and a permanent gait impairment.
  • A $295,000 settlement in favor of our client who sustained severe fracture injuries as a passenger in a single vehicle rollover accident.
  • A $300,000 policy limits settlement in favor of our client who was t-boned by the opposing motorist resulting in two back surgeries, including a fusion and hardware implantation.
  • A $250,000 settlement in favor of our client who sustained serious injuries after his truck collided with a black cow on Interstate 84 at 65 miles per hour at midnight — the cause was negligently maintained fencing. We successfully defeated the so-called “open range doctrine.”
  • A $250,000 settlement in favor of our client in an insurance bad faith case involving a life insurance policy. The face value of the policy was for $150,000, and we recovered an additional $100,000 over and above that for interest, litigation costs, and attorney fees due to the improper denial by the insurance company.
  • A $230,000 workers compensation settlement (close to the maximum amount allowed under the workers compensation statutes given this worker’s particular wage-level) in favor the family of a deceased laborer from Mexico who died after he returned to Mexico after suffering a fracture injury here in the United States.
  • A $150,000 settlement for our client against a local bar that over-served a patron whose vehicle struck and ran over our client in the bar’s parking lot.
  • A $125,000 settlement for our 65 year old client who fell on a faulty manhole cover in a bus garage and severely fractured his patella.
  • A $100,000 settlement for our elderly client who was rear-ended on the freeway as traffic was slowing to a stop.
  • An $80,000 settlement for our client who was struck by a drunk driver and suffered a fractured nose.
  • A confidential settlement in a complex case of dental malpractice involving cosmetic dental restorations.
  • The firm obtained a large, confidential settlement on behalf of our client in an employment law case following a ruling by the federal court on summary judgment that the corporate employer had violated the Family Medical Leave Act (“FMLA”).
  • A confidential settlement for the client in a case against a major bicycle manufacturer wherein the bike frame split in two and collapsed causing severe facial and dental injuries and permanent scarring.
  • A confidential settlement for the client arising from a charge of pregnancy discrimination brought against a large local corporate employer.
  • A substantial settlement for our client against the manufacturer and retailer of an aquarium chemical that exploded and burned the corneas off of his eyes.
  • A substantial settlement against a major pharmacy chain in favor of the client who was injured due to a mislabeled prescription antibiotic.
  • A favorable settlement on behalf of the client who alleged he was assaulted and battered by a bouncer at a local bar.
  • A six figure plus settlement, including amounts for attorney fees and interest, in favor of the client in a breach of produce supply contract case.
  • A significant settlement for a young couple against a large building company who breached a real estate contract to build the couple a new home.
  • Complete summary judgment on behalf of his defendant client in a product liability case against a t-shirt manufacturer wherein the plaintiff child received 3rd degree burns over the majority of his torso due to the allegedly flammable nature of the t-shirt fabric. The Idaho Supreme Court unanimously upheld the dismissal in October of 2006.
  • A six-figure plus settlement in a challenging toxic mold case involving respiratory injuries to a tenant of an apartment complex. The case settled shortly after the court granted the plaintiff’s motion for punitive damages against the property management company.
  • A substantial settlement in a case involving a weed-trimmer blade injury wherein a metal cutting blade detached from the trimmer and impaled the client’s leg, causing a severe fracture injury and permanent scarring. Punitive damages were sought to punish and deter the manufacturer of this dangerous and defective product.
  • A confidential settlement for our client who suffered a major leg injury when a saw rented from a local rental company kicked-back during use. It was discovered that the saw was rented without its key safety guard. Punitive damages were sought to punish and deter the local rental company.
  • Patrick was part of the litigation team that achieved a confidential settlement in a serious carbon monoxide poisoning case involving an unsafe and negligently installed residential heating system.
